General Terms and Conditions of Sale

Article 1: Scope and Modification of General Terms and Conditions of Sale

These general terms and conditions of sale govern the relationship between the company SAS SeaLabX (hereinafter referred to as « SeaLabX »), with variable capital, registered office located at: 820 route de Kernisi, 29470 Plougastel-Daoulas, France (SIRET No. 922 922 273 00011), and the Customer wishing to place an order. They apply to all orders. SeaLabX reserves the right to adapt or modify these General Terms and Conditions of Sale at any time. In the event of modification, the General Terms and Conditions of Sale in force on the day of the order shall apply to each order. At the time of placing the order, the Customer acknowledges having read and agreed to the General Terms and Conditions of Sale below.

Article 2: Product Availability

Our product offers and prices are valid as long as they are visible on the websites listed in the shop section of www.sealabx.com, within the limit of available stocks.
Upon receipt of your order, we verify the availability of the ordered product(s). In case of unavailability, we undertake, within 30 days from order validation, to either deliver the ordered product, propose a similar product at a similar price, or invite you to choose another product on the site.
The order validation date corresponds to:

  •  The order date in case of online credit card payment.
  • The date of check receipt in case of payment by check.
    In case of stock shortage on one of the products in your order, we will ship the remainder of your order.
Article 3: Prices
3.1 – General:

SeaLabX reserves the right to modify its prices at any time but undertakes to apply the rates in force that were indicated to you at the time of your order. All prices indicated are in euros, including all taxes, and exclude handling, preparation, or shipping costs.

3.2 – Specific Conditions for Sale Items:

During Sale periods, sale items are identifiable by signage bearing the mention « SALES » located next to the price.

Article 4: Payment Methods and Security
4.1 – Payment Methods:

You can make payment:

  • By credit card: payment is processed on the secure banking servers of our banking partners BPGO and PayPal. This implies that no banking information concerning you passes through our website. Credit card payment is therefore perfectly secure; your order will be recorded and validated upon payment acceptance by the bank.
  • By bank check: your order is then reserved for 7 days. Beyond this period, without receipt of your check, it will be canceled. The order will only be processed upon receipt and validation of your check. The bank check must be made out in euros to the order of SeaLabX and sent to the following address: SAS SeaLabX, 820 route de Kernisi, 29470 Plougastel-Daoulas, France.

4.2 – Security:

Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never transit in clear text over the network. Payment is made directly to the bank. SeaLabX under no circumstances has access to these details and does not store them on its servers. This is why they are requested again for each new transaction on our site.

4.3 – Retention of Title Clause:

Products remain the property of SeaLabX until full payment of the order is received. However, from the moment the order is received by the customer, the risks for the delivered goods are transferred to the customer.

4.4 – Payment Default:

SeaLabX reserves the right to refuse delivery or honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is currently under administration.

Article 5: Delivery Methods and Timeframes in Metropolitan France
5.1 – General:

Products are delivered to the delivery address you provided during the ordering process. In case of an error on your part, if the package is returned to us, you will be required to pay for a second shipment. If there is a cancellation request, only the product will be refunded, as we have already sent it to you.

5.2 – Packages under thirty kilograms:

Delivery via La POSTE, DHL, or FEDEX: the contribution to order processing, packaging, and delivery costs varies according to the delivery method but is indicated to you before finalizing your order. For « Overseas » and « International » shipments, processing, packaging, and delivery costs are calculated based on the exact weight of the order and the destination. Please note, no delivery dispute concerning a direct Colissimo (or non-tracked Colissimo) will result in compensation from SeaLabX by La Poste. Consequently, no claim regarding non-receipt of a direct or non-tracked Colissimo will be accepted by our services beyond one month after shipment.

5.3 – Packages over thirty kilograms:

Delivery by a general CARRIER, GLS, DHL, or FEDEX; prices are indicated during your order.

5.4 – Shipping Timeframes:

All announced timeframes are calculated in business days. The indicated timeframes are average and correspond to the processing, preparation, and shipping times of your order. They start from order validation. To this timeframe, the carrier’s delivery time (La Poste / Carrier) must be added. Generally, for an item available in stock: the product category, its location, weight, and size can vary the preparation and shipping time for an in-stock item. Main timeframe for in-stock products: shipped within 48 hours. When the product is not in stock: we will then indicate an availability timeframe.

5.5 – Delivery Timeframes:

The ordered product is delivered by the postal system or by an independent carrier, depending on the nature of the ordered product and at the exclusive initiative of SeaLabX, to the address appearing on the order form. The announced timeframes are indicated from our warehouses. The choice of delivery method depends on the weight, volume, and value of the items.

Article 6: Liabilities
SeaLabX cannot be held responsible for the non-execution of the concluded contract due to the occurrence of any events, of any nature whatsoever, beyond the control of SeaLabX. Likewise, in the event of force majeure, and particularly in case of total or partial strike of postal services, carriers, and natural disasters caused for example by floods or fires. The choice and purchase of a product are placed under the sole responsibility of the customer. The total or partial impossibility of using the products cannot give rise to any compensation, refund, or challenge of SeaLabX’s liability, except in the case of a proven hidden defect, non-conformity, defectiveness, or exercise of the right of withdrawal as envisaged under Article 9.3. SeaLabX declines all liability regarding the use of the products sold. By accepting the general terms and conditions of sale, the buyer certifies that they will use the sold items for their traditional uses, respecting and reading the instructions.
Article 7: Handling of Packages Not Delivered by the Provider
These are packages that were not delivered to the final recipient for the following reasons: NPAI (Does Not Live at the Indicated Address), unclaimed, refused, transport damage, etc.

7.1 – Returns under the reason « NPAI »:

General: these are packages returned by the delivery provider under the mention: « N’habite Pas à l’Adresse Indiquée » (Does Not Live at the Indicated Address). Handling an NPAI return: after receipt and acceptance of your package by our services, depending on the products, available stocks, and according to your wish, we will propose to resend the originally ordered product or an exchange product to your address, which we will modify. If the error was on your part, you will be required to pay for a second shipment; if there is a cancellation request, only the product will be refunded, as we have already sent it to you.

7.2 – Returns under the reason « Unclaimed »:

General: these are packages that were not claimed by customers at the Post Office within the allotted time. Handling an « Unclaimed » return: after receipt and acceptance of your package by our services, we will notify you. Depending on the products, available stocks, and according to your wish, we will propose to resend the originally ordered product at your expense or an exchange product involving additional costs.

7.3 – Returns under the reason « Refused »:

You refused your package at the time of delivery due to cancellation; after receipt and acceptance of your package by our services, only the product will be refunded, as we have already sent it to you. You refused the package because it showed obvious signs of opening and/or impact:

  • For products under 30kg: If the package is damaged, torn, open… you must imperatively refuse the package and contact our services to inform us. If the provider in charge of delivering your package is La Poste, you must specifically request a damage declaration at the time of refusal. After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks, and according to your wish, we will propose to resend the originally ordered product or an exchange product.
  • For products over 30kg: At the time of delivery, in the presence of the driver, before signing the delivery slip, and thus accepting the package, you must verify the condition of the package and your product. In case of OBSERVED DAMAGE, you must formulate specific reservations* on the delivery slip.

* The mention « subject to unpacking » does not constitute a specific reservation and has NO LEGAL VALUE.

It is therefore essential that you precisely describe the condition of the packaging and/or your product (e.g., Package open, packaging damaged, torn, dented… on the bottom right corner, on the left side…). You must also confirm these reservations to the carrier by registered mail no later than 72 business hours following receipt of the article(s), and transmit a copy of this letter to: SAS SeaLabX, 820 route de Kernisi, 29470 Plougastel-Daoulas, France, clearly referencing the details on the delivery slip.

Note: Verification of your product’s condition is considered performed once the delivery slip has been signed. Consequently, IN CASE OF NON-COMPLIANCE WITH THE ABOVE INSTRUCTIONS, NO CLAIM WILL BE ADMISSIBLE. (Article L.133-3 of the Commercial Code).

If your product is truly damaged, you must imperatively refuse the package and note a reservation on the delivery slip (package refused because open or damaged during delivery, precisely characterize the damage). You must also confirm these reservations to the carrier by registered mail no later than 48 business hours following receipt of the article(s), and transmit a copy of this letter to: SAS SeaLabX, 820 route de Kernisi, 29470 Plougastel-Daoulas, France, clearly referencing the details on the delivery slip.

NOTE: Verification of your product’s condition is considered performed once the delivery slip has been signed. Consequently, IN CASE OF NON-COMPLIANCE WITH THE ABOVE INSTRUCTIONS, NO CLAIM WILL BE ADMISSIBLE. (Article L.133-3 of the Commercial Code).

In the absence of reservations, the goods are deemed accepted by the Customer and cannot be subject to any subsequent dispute. « The buyer will be required to pay the full price. »

7.4 – Returns under the reason « Damage/Loss »:

General: these are packages that were not delivered to the customer due to damage/loss: open package, signs of impact, empty package… Handling a « Damage/Loss » return: after receipt and acceptance of your package by our services, depending on the nature of the product, available stocks, and according to your wish, we will propose to resend the originally ordered product or an exchange product with equivalent characteristics.

Article 8: Right of Return
8.1 – Return Procedure and General Conditions

To properly process your request, please provide your order reference and your full contact details. We advise you to make the return via tracked Colissimo. Otherwise, if the package, sent by you and returning to our services, does not reach us, you would not be able to launch an inquiry with the postal services to locate it. Please note that any package not shipped by us is not under our responsibility. Only the sender of the package is able to launch an inquiry with the postal services. Note: Upon receipt, our services will check the conformity of the returned product and the reason for return. If the returned product is not compliant, it will be refused by our services and sent back to you at your expense. If your return is made under an incorrect reason, your product may be refused and thus sent back to you at your expense. The reason for return may notably be reclassified. You will then be informed by email, and the processing of your return will depend on the new reason.

8.2 – Returns for Reference Error

Return conditions: you have 7 days to inform us that the product received is not the product ordered: reference error, size problem, color, characteristics, completely different product… The product must be returned in good condition and in its original packaging, even if opened, with all its contents (accessories…). To properly process your request, please provide your order reference and your full contact details. If it turns out the error is on our part, we will take care of having the package picked up at our expense; if, without our agreement, you return the product at your expense, we cannot refund your shipping cost. Processing your return for reference error: after receipt and acceptance of your package by our services, depending on the nature of the product, available stocks, and according to your wish, we will propose to resend the originally ordered product or an exchange product with equivalent characteristics. Attention: No returns via a relay point will be accepted. A Colissimo is mandatory.

8.3 – Returns for Withdrawal

Return conditions: SeaLabX allows you to benefit from the 14 clear days provided by Article L. 121-20 of the Consumer Code to return a product that does not satisfy you, without penalty, except for return shipping costs to our warehouse: SAS SeaLabX, 820 route de Kernisi, 29470 Plougastel-Daoulas, France. This period starts from the date of delivery of your package. You therefore have 14 days to inform us that you wish to withdraw so that our customer service assigns you a return authorization number. ATTENTION: No withdrawal will be accepted if the returned product is unfit for resale. The product must be accompanied by all its accessories. Failing this, the product will be returned to you at your expense. Processing your return for withdrawal: after receipt and acceptance of your package by our services, depending on the nature of the product, available stocks, and according to your wish, we will propose to resend an exchange product of equivalent value. Otherwise, SeaLabX undertakes to refund your product within a maximum of 30 days, by credit, bank transfer, or check, according to the initially used payment method, deducting shipping costs; only the article(s) will be refunded.

8.4 – Returns for Defective Product

Application conditions: from receipt of your package, you have 14 days to inform us of the receipt of a defective product. When requesting a return, it is essential that you describe the problem encountered with your product as best as possible. Exclusions:

  • Products not justifying a proven defect after diagnosis by our services
  • A defect attributable to misuse of the product
  • Damage or defects attributable to external causes
  • Products returned without return authorization and not fulfilling the return conditions specified in the return authorization number email.

Processing your return for a defective product upon unpacking or within 14 days: Do not send your package without contacting us; no refund of your shipping costs will be possible. After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks, and according to your wish, we will propose to resend an exchange product of equivalent value. Processing your return for a defective product after 14 days following receipt: Return shipping costs for after-sales service are your responsibility; reshipment of the repaired or exchanged product is our responsibility. After receipt and acceptance of your package by our services, depending on the nature of the product and the after-sales service diagnosis, available stocks, and according to your wish, we may propose to resend an exchange product of equivalent value. Note: No refund of shipping costs will be made; we have return services in case of need (breakdown upon unpacking or breakdown within 14 days); beyond this period, we operate on shared costs: the return is your responsibility, the reshipment is ours.

8.5 – Product Return Procedure

Article 9: Provisions of the « Data Processing and Liberties » Law

The information you provide us is essential for processing and shipping orders, as well as establishing invoices and warranty contracts; their absence results in the cancellation of your order. By registering on the seller Site, you undertake to provide us with sincere and truthful information concerning you. The communication of false information is contrary to these General Terms and Conditions of Sale. You thus authorize SeaLabX to collect, process, and use information concerning you.
SeaLabX is the sole holder of information concerning you. You may at any time make a request to SeaLabX to know what information concerning you is held by SeaLabX, to object to their processing, to have them modified or deleted, by contacting customer service. We also inform you that cookies may record certain information stored in your hard drive memory. This information serves us to generate audience statistics for the seller Site and to propose products based on items you have already selected during your previous visits. An alert message asks you beforehand if you wish to accept cookies. These cookies do not contain confidential information concerning you.

Article 10: Service Modifications and Interruption

SeaLabX reserves the right to temporarily modify or interrupt all or part of these services for technical reasons or compliance, without prior notice to the consumer.

Article 11: Intellectual Property

All elements of the sites of products marketed by SeaLabX, whether visual or sound, including the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of SeaLabX.

Article 12: Applicable Law – Disputes

This contract is subject to French law. The language of this contract is French. In case of dispute, French courts shall have sole jurisdiction.
